Privacy Policy

Effective Date: March 3, 2026

At Fortytwo ("we", "us", and "our"), we consider your privacy to be extremely important. This Privacy Policy applies to the products and services we offer on the Microsoft AppSource and Azure Marketplace, as well as our related websites. It sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed and protected.

1. Information We Collect from You

We collect personal information from you in a number of different ways, primarily when you interact with our products or services on the Microsoft Marketplace. The information we collect may include:

  • Information you give us: This is information you provide by registering to use our offerings, interacting with our listings, requesting support, or corresponding with us by phone, e-mail, or otherwise. This may include your first name, last name, company name, job title, phone number, email address, and organizational details.
  • Support and Feedback: Information provided during support requests, feedback submissions, or troubleshooting.

IMPORTANT: Self-Hosted Offerings vs. Hosted Services For our self-hosted marketplace offerings (products you deploy and manage within your own environment or infrastructure), we do not collect any telemetry, usage data, or personal information from the software itself. We only collect information from our offerings if they are explicitly hosted and managed by us (SaaS offerings), or if you directly provide that information to us (e.g., through billing, marketplace transactions, or support inquiries).

2. How We Use the Information We Collect

We use the information held about you in the following ways:

  • To provide services: To carry out our obligations arising from any contracts entered into between you and us, and to provide you with the information, products, authenticate access, and services that you request from us.
  • To support and improve: To provide customer support, fix errors, analyse trends, and study how users interact with our hosted services.
  • To market to you: We will combine this information with information you give to us. Crucially, we may use the information you provide us to market our products or services to you. This includes notifying you about other goods and services we offer that are similar to those you have already purchased, enquired about, or that we feel may interest you.
  • Compliance: To comply with legal and regulatory requirements or to contact you if your actions violate your agreement with us.

3. Disclosure of Your Information

We don't share your personal information with anyone except to provide you with services, products, to comply with the law, or to protect our rights.

We may disclose your information to third parties:

  • If we use trusted third-party service providers (such as business partners, payment processors, or sub-contractors) who assist us in operating our services, provided they adhere to confidentiality obligations.
  • If we are under a duty to disclose or share your personal data to comply with any legal obligation, or to enforce or apply our terms of use.
  • In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer.

4. How Do We Protect Your Information

We are concerned about protecting the confidentiality of your personal information. We have security measures in place—including administrative, physical, and electronic measures—to protect against the loss, exposure, misuse, or alteration of the information we have collected from you. No transmission over the internet is completely secure, but we do our best to protect your personal data once we have received it.

5. Your Rights

Depending on your jurisdiction, under data protection legislation you may have the right to:

  • Access, rectify, or erase your personal data.
  • Withdraw your consent to our processing of personal data for marketing purposes. You can exercise this right at any time by following the unsubscribe instructions in our marketing emails or by contacting us.
  • Ask us to restrict the processing of your data or request data portability.

6. Changes to Our Privacy Policy

Any changes we may make to our privacy policy in the future will be posted on this page and, where appropriate, notified to you by email. Please check back frequently to see any updates or changes.
